Local Planning Appeal Tribunal Process Update

As part of the development process for the Kingsway Entertainment District, a number of appeals were filed with the Local Planning Appeal Tribunal (LPAT) for the Official Plan amendment and rezoning of land on the Kingsway. The first step in that process, the case management conference, took place today in Sudbury.

LPAT has agreed to hear motions from the parties on procedural and jurisdictional matters. The motions will be submitted to LPAT in the next two weeks for its consideration. A date has not yet been set for the next case management conference or hearing, and no decisions were rendered today on the appeals.

“We are confident that the planning decisions that were made in regards to this development are consistent with all applicable legislation and documents, including provincial policy statements, the Growth Plan for Northern Ontario, the City’s Official Plan and the Planning Act,” said Tony Cecutti, General Manager of Growth and Infrastructure. “We look forward to participating in the next steps of this process.”

The City will meet with its partners over the coming weeks to discuss next steps.
