Temporary Outdoor Patio, Sidewalk Café & Outdoor Retail Guidelines

 
  1. Temporary Outdoor Patios, Sidewalk Cafes and Outdoor Retail spaces (“Outdoor Space”) shall only be permitted until November 30th; however, the City of Greater Sudbury (“City”) may terminate these permissions upon 24 hours notice.
  2. Outdoor Spaces must have a valid City of Greater Sudbury business licence/registration to operate.
  3. On-site parking may be used for an Outdoor Space, except the required number of designated Accessible Parking Spaces, which must remain available for parking use.
  4. Outdoor Spaces shall be permitted adjacent to and abutting the business’ frontage and or flankage.  Outdoor Spaces may extended across an adjacent business frontage if written permission is provided by the owner/operator of the adjacent business.
  5. No Outdoor Space shall be permitted within 6 m of a street intersection or a public laneway without receiving written permission from the City.
  6. Patrons of an Outdoor Space associated with a Restaurant must be able to use the indoor washrooms of the restaurant.
  7. No outdoor speakers or sound systems may be used.
  8. CSA-certified electric or propane patio heaters (with max 20 lb tank) are permitted where located at least 3 m (10 ft) away from City tree branches, operated per the manufacturer’s directions. Solid-, gel- or liquid-fuel fire features are not permitted. 
  9. Adequate fire extinguisher coverage must be provided.
  10. Any signs erected must abide by the City of Greater Sudbury Sign Bylaw.
  11. The City of Greater Sudbury will have the right to suspend these permissions based on unresolved complaints.
  12. Access to Fire Department connections or exits from adjacent buildings must be maintained.
  13. If a Fire Route is occupied by an Outdoor Space, a suitable alternate Fire Route must be delineated.
  14. It is the responsibility of the Applicant to meet all licensing requirements that would normally be required to operate their business (Fire Services, Public Health, AGCO, etc.) and provide confirmation of same.
  15. Smoking will not be permitted on any outside Outdoor Space as per provincial regulations.
  16. Applicant agrees to meet all pertinent portions of the City of Greater Sudbury's current bylaws.
